Daniel Rodriguez Martinez, Wire Fraud Conspiracy, Texas 2023

McALLEN, Texas – A brazen scheme to defraud electricity providers and bilk unsuspecting customers out of power payments has landed a 51-year-old Houston man in federal prison. Daniel Rodriguez Martinez was sentenced this week to 54 months behind bars for conspiracy to commit wire fraud, U.S. Attorney Nicholas J. Ganjei announced.

Martinez pleaded guilty May 1, admitting to a central role in a three-year operation that siphoned off an estimated $4 million through a network of fake accounts and stolen identities. Chief U.S. District Judge Randy Crane didn’t mince words, ordering the 54-month sentence to be immediately followed by three years of supervised release. Court records revealed Martinez personally pocketed $1.4 million from the illicit scheme.

Between March 2021 and May 2024, Martinez and his co-conspirators built a shadow utility company designed to funnel profits from a sophisticated fraud. They pilfered Social Security numbers and other personal information, using them to open electricity accounts with legitimate providers linked to actual residential addresses. This allowed them to provide power to customers while the bills went unpaid, leaving victims to shoulder the financial burden.

When providers inevitably cut service for nonpayment, the crew simply reopened accounts under freshly stolen identities, ensuring a continuous flow of electricity for those willing to pay. Customers paid a flat $80 monthly fee to the fraudulent company, effectively bypassing legitimate charges and lining the pockets of the organizers. Martinez’s contribution was crucial: he created the shell company specifically to conceal the flow of stolen funds.

Payments were funneled through peer-to-peer apps like CashApp and Zelle, then laundered into business accounts to obscure their origin. As part of his guilty plea, Martinez agreed to forfeit $456,859.76 in U.S. currency, as well as his ownership stake in multiple properties. The FBI spearheaded the investigation, with Assistant U.S. Attorney Jose A. Garcia handling the prosecution.

Martinez remains in custody pending transfer to a Federal Bureau of Prisons facility. This case serves as a stark reminder that exploiting vulnerabilities in essential services like electricity will be met with serious federal consequences. The Grimy Times will continue to follow this case and report on any further developments.
