CLEVELAND, OH – Malcolm L. Hoyle, 27, is facing federal charges after being indicted for illegally possessing a firearm, the U.S. Attorney’s Office for the Northern District of Ohio announced today. The indictment comes after an investigation into Hoyle’s continued criminal activity despite a decade-long record of violent offenses and drug convictions.
Hoyle is charged with one count of being a felon in possession of a firearm and ammunition. According to the indictment, on July 8, 2014, Hoyle was found to be in possession of a .40-caliber pistol and accompanying ammunition, a clear violation of federal law given his extensive criminal background.
That background includes a 2003 conviction for involuntary manslaughter in Cuyahoga County Court of Common Pleas, followed by a 2005 conviction for felonious assault. The pattern of criminal behavior continued with two separate convictions in 2008 for drug trafficking, and another in 2009 for attempted failure to comply with law enforcement. This isn’t a first-time offender; it’s a repeat offender brazen enough to arm himself despite his history.
The case is being prosecuted by Assistant U.S. Attorney Kelly L. Galvin, with a joint investigation led by the Cleveland Division of Police and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Sources inside the investigation suggest Hoyle’s activities were flagged during a routine check following a minor traffic stop, uncovering the illegal firearm.
If convicted, Hoyle’s sentencing will be determined by the court, taking into account federal sentencing guidelines, the specifics of the offense, and, crucially, his extensive prior criminal record. The government will undoubtedly push for a significant sentence given the severity of his past convictions and the current charge.
