Dalvert Encarnacion Francisco, a 37-year-old from Dubuque, Iowa, has been sentenced to 70 months in federal prison for distributing child pornography to a resident in Panama City. The crime was uncovered after the Bay County Sheriff’s Office investigated multiple tips from the National Center for Missing and Exploited Children. The defendant was found to have distributed the material to an individual named Marcus Creel, who was later prosecuted by the Office of the State Attorney of the Fourteenth Judicial Circuit.
The investigation, which involved the Federal Bureau of Investigation, revealed that Francisco requested online payments for the child sexual abuse material he distributed. The sentence follows a guilty verdict returned after a three-day jury trial in May 2026. U.S. Attorney John P. Heekin praised the work of law enforcement partners, stating that anyone who views, possesses, or distributes child sexual abuse material will face aggressive prosecution.
Bay County Sheriff Tommy Ford emphasized that protecting children is a top priority, and that those who exploit them will be held accountable. Francisco will be required to serve five years of supervised release and register as a sex offender upon his release from prison.
