Brian Holland, Aggravated Sexual Abuse by Force, FL 2018

Jacksonville man Brian Holland, 23, was arrested and charged by criminal complaint with aggravated sexual abuse by force following a violent assault aboard the Carnival Cruise Line vessel Elation on February 27, 2018. The federal charge carries a maximum penalty of life in prison and a potential lifetime of supervised release if convicted.

According to the criminal complaint, Holland was in the ship’s Jacuzzi with the victim when he began making aggressive physical advances. The woman stated he repeatedly tried to put his arm around her. When she moved away, Holland grabbed her shoulder and pulled her back toward him. She reported that he then touched her over her bathing suit, followed by digital penetration under her swimwear — all done by force.

The victim fled the Jacuzzi immediately after the assault and reported the incident to family members, who alerted ship security. Medical personnel aboard the vessel examined her and documented abrasions on her genitals consistent with forcible digital penetration, providing physical evidence to support her account.

Federal agents from the Federal Bureau of Investigation were notified by Carnival security and swiftly moved to apprehend Holland. He was taken into custody upon the ship’s return to U.S. waters. Holland made his initial appearance in federal court in Jacksonville, where he was temporarily detained. A detention hearing was scheduled for March 6, 2018, to determine whether he would remain in custody pending trial.

The case underscores the reach of federal jurisdiction in crimes committed on cruise ships, particularly those sailing under U.S. flags or operating out of American ports. Aggravated sexual abuse by force is a felony under federal law, and prosecutors are treating the incident with the severity it warrants. Brian Holland is presumed innocent unless proven guilty in a court of law.

This investigation was conducted by the Federal Bureau of Investigation. The case is being prosecuted by Assistant United States Attorneys Ashley Washington and Jay Taylor. If convicted, Holland faces life behind bars and lifelong federal supervision.
