Former NYPD Officer Pleads Guilty to Bribery Scheme
James Davneiro, a 43-year-old former NYPD officer, pleaded guilty to conspiring to participate in a bribery scheme in federal court in Brooklyn, New York.
Davneiro, who was assigned to the 107th Precinct in Queens, New York, at the time of the scheme, received thousands of dollars in bribes from another former NYPD officer, Michael Perri, in exchange for steering vehicles damaged in automobile accidents to a licensed tow trucking and automobile repair business operated by Perri.
According to court filings and facts presented at the plea proceeding, between May 2020 and May 2021, Davneiro received bribes from Perri in exchange for steering vehicles to the tow trucking and automobile repair business. The scheme contravened the NYPD’s Directed Accident Response Program (DARP), which requires the NYPD to identify appropriate licensed tow trucking and automobile repair businesses to respond to automobile accident scenes and remove damaged vehicles.
Davneiro pleaded guilty to conspiring to participate in the scheme, which is punishable by up to five years in prison. He has also agreed to forfeit $25,000 as part of his plea agreement.
The scheme involved Davneiro and another former NYPD officer, Giancarlo Osma, who pleaded guilty to conspiring to participate in the scheme on November 16, 2022. Osma, who was also assigned to the 107th Precinct in Queens, New York, received thousands of dollars in bribes from Perri in exchange for steering vehicles to the tow trucking and automobile repair business.
A third former NYPD officer, Michael Perri, pleaded guilty to conspiring to participate in the scheme on November 15, 2022. Perri, who was also assigned to the 107th Precinct in Queens, New York, operated a licensed tow trucking and automobile repair business that received the damaged vehicles pursuant to the scheme.
Perri has agreed to forfeit approximately $158,277 as part of his plea agreement. Osma has agreed to forfeit approximately $26,011.
The case is being handled by the Office’s Public Integrity Section, with Assistant United States Attorney Ryan C. Harris in charge of the prosecution.
The defendants will face sentencing before United States District Judge Rachel P. Kovner.
