A Clark County School District police officer has been indicted on federal charges for allegedly using excessive force against a student and a school staff member at the Jeffrey Behavior School in Las Vegas, Nevada.
According to the indictment, Officer James Lescinsky, 45, unlawfully assaulted the school staff member, identified as T.R., by striking her with his police-issued baton, causing bodily injury. He is also accused of assaulting a student, identified as A.N., by striking her with the baton and slamming her into a hallway wall and floor.
The indictment charges Lescinsky with five counts, including deprivation of rights under color of law, which carries a maximum sentence of 10 years in prison. He is also charged with witness tampering, which carries a maximum sentence of 20 years in prison.
Lescinsky allegedly made false representations to his supervisor about the incident and falsified official reports, including an incident report and a use of force report.
The case is being investigated by the FBI’s Las Vegas Division and is being prosecuted by Trial Attorneys Adam Harris and Dana Mulhauser of the Civil Rights Division’s Criminal Section.
An indictment is merely an accusation, and Lescinsky is presumed innocent unless proven guilty.
