Jermell Toney, Escape from Custody, Ohio 2021

A 35-year-old Toledo man is behind bars after a federal grand jury returned an indictment charging him with one count of escape.

Jermell Toney, a Toledo resident, is accused of failing to report to a re-entry program required to complete the service of a 13-month federal prison sentence imposed for violation of supervised release, according to court records.

The incident occurred on September 17, 2021, when Toney allegedly failed to report to the re-entry program as required. He eventually surrendered himself to the United States Marshals Service on September 28, 2021.

An indictment is only a charge and is not evidence of guilt. A defendant is entitled to a fair trial in which it will be the government’s burden to prove guilt beyond a reasonable doubt.

According to the indictment, if convicted, Toney’s sentence will be determined by the Court after review of factors unique to this case, including his prior criminal records, his role in the offense, and the characteristics of the violation.

In all cases, the sentence will not exceed the statutory maximum, and, in most cases, it will be less than the maximum.

The investigation was conducted by the United States Marshals Service, with the case being prosecuted by Assistant United States Attorney Deyana Unis.

Toney’s current status remains unclear, but he is facing a serious charge that could result in significant consequences.

Toney’s prior criminal records, if any, will be a key factor in determining his sentence, along with his role in the offense and the characteristics of the violation.

As Toney navigates this serious charge, it remains to be seen how this case will play out in court.
