A Great Falls, Montana man was sentenced to 24 months in federal prison for his role in a brutal assault that left a woman with serious injuries.
Jess James Rutherford, Jr., 28, was sentenced on October 22, 2013, before Chief U.S. District Judge Dana L. Christensen for his guilty plea to assault resulting in serious bodily injury.
According to the government’s Offer of Proof, the assault occurred on April 23, 2013, when Rutherford locked the victim outside of their home, then beat her when she tried to return inside.
The victim, who had dated Rutherford for eight months, stated that Rutherford threw her to the ground, stomped on her, and punched her repeatedly, causing deep bruising on her chest, among other injuries.
After the assault, the victim waited for Rutherford to fall asleep, then ran to a neighbor’s house and went to the hospital, where she was treated for two broken ribs and a bilateral and impacted nasal fracture.
Rutherford’s sentence also includes a $100 special assessment and three years of supervised release.
Because there is no parole in the federal system, Rutherford will likely serve all of the time imposed by the court, although he may be eligible for a sentence reduction of up to 15% for good behavior.
The investigation was conducted by the Bureau of Indian Affairs.
