A hard-hitting crime journalist for Grimy Times has uncovered a shocking case of immigration discrimination in Indiana.
According to court documents, JMJ Talent Solutions, Inc., a staffing company with four locations throughout Indiana, has agreed to settle charges of immigration discrimination with the US government.
At the center of the case is a provision of the Immigration and Nationality Act (INA) that prohibits employers from discriminating against workers based on their citizenship status or national origin.
The US government alleged that JMJ Talent Solutions engaged in discriminatory practices when it requested specific documents from non-US citizen workers to prove their eligibility to work in the United States.
Employees who were unable to provide the requested documents were allegedly subjected to unfair treatment, including being asked to produce additional documentation or being denied employment opportunities.
The settlement, which was reached on February 26, 2024, requires JMJ Talent Solutions to pay a civil penalty, publish notifications to inform workers of their rights under the INA, train its employees, and submit to supervision by the US government for three years.
According to the US government, JMJ Talent Solutions’ actions violated the INA’s antidiscrimination provision, which prohibits employers from rejecting documentation that reasonably appears to be genuine and belongs to the person presenting it, requesting specific documentation from workers, or asking for more documentation than is required to prove their eligibility to work.
