Former CEO of Comprehensive Pain Specialists Convicted in Medicare Kickback Scheme

Nashville, Tennessee – In a shocking turn of events, a former CEO of Comprehensive Pain Specialists has been convicted of orchestrating a massive Medicare Kickback scheme, netting $4 million in illicit gains.

John Davis, 43, of Franklin, Tennessee, was convicted of one count of conspiracy to defraud the United States and violate the Anti-Kickback Statute, as well as seven counts of violating the Anti-Kickback Statute. The conviction came after a seven-day trial in April 2019.

Davis’s scheme involved submitting false claims for medically unnecessary and/or non-reimbursable testing and acupuncture, a move that ultimately led to his downfall. The United States Attorney’s Office for the Middle District of Tennessee and the Tennessee Attorney General’s Office handled the case, while the Department of Health and Human Services, Office of Inspector General and the Tennessee Bureau of Investigation Medicaid Fraud Control Unit investigated the matter.

In July 2020, Davis was sentenced to 42 months in prison for his role in the scheme. However, his sentence was commuted by then-President Donald J. Trump earlier this year.

As part of a permanent voluntary exclusion from participation in federal procurement and non-procurement programs, Davis agreed not to be employed in any industry or field in which he could, either directly or indirectly, submit claims seeking reimbursement from Medicare and other Federal health care programs.

The United States previously resolved its claims against Comprehensive Pain Specialists, its owners, and a former manager. This settlement resolves the remaining allegations against Davis and results in the dismissal of the Civil Action.

The Civil Action was captioned United States and the State of Tennessee ex. rel. Suzanne Alt, et al. v. Anesthesia Services Associates, PLLC, et al., and was handled by Assistant U.S. Attorney Kara F. Sweet.
