The case, known as United States v. Gagliardi, was tried in the United States District Court for the Eastern District of Pennsylvania, with the defendant facing a slew of charges including assault with a deadly weapon, kidnapping, and possession of a firearm by a convicted felon.

His trial began on March 14, 2005, and after a lengthy and intense proceeding, the jury returned a verdict of guilty on all counts on April 15, 2005. Sentencing was held on June 17, 2005, and Gagliardi was sentenced to 25 years in prison, followed by five years of supervised release.
