A Nicholas County man has admitted to a federal crime involving a minor, sending shockwaves through the community. John Marshall Underwood, Jr., 44, of Gilboa, pleaded guilty to attempted enticement of a minor to engage in sexual activity. This crime is a serious offense that carries a minimum sentence of 10 years and up to life in federal prison.
The investigation began on December 14, 2016, and continued through February 1, 2017. Underwood used his cell phone to communicate with an undercover law enforcement officer, who he believed was a prostitute with custody of two minor nieces. He attempted to entice one of the nieces to engage in commercial sexual activity on at least two occasions.
The law enforcement officers, who were posing as the niece and her mother, recorded all the calls between Underwood and the undercover officers. Underwood arranged a meeting with the individuals who were actually undercover officers and was arrested after he arrived at the meeting location on February 1, 2017.
Underwood will be required to register as a sex offender as part of his sentence. Sentencing is scheduled for September 20, 2017. The investigation was conducted by the Charleston Police Department, the West Virginia State Police, and Homeland Security Investigations. Assistant United States Attorney Jennifer Rada Herrald is in charge of the prosecution.
