Disbarred Lawyer Sentenced to Prison for Client Fund Theft in Florida

MIAMI – A federal district judge in Ft. Lauderdale sentenced disbarred lawyer John Spencer Jenkins to 33 months’ imprisonment for misusing more than three quarters of a million dollars of his clients’ money.

Jenkins, who was once licensed to practice law in Florida, was ordered to serve his sentence after admitting to misusing funds from his clients’ IOTA business account and general business account. The court documents revealed that Jenkins’ clients wired funds into his law firm’s accounts with the intention of receiving legal services, but Jenkins instead used those funds for his own personal gain.

According to the plea documents and information provided during the sentencing hearing, Jenkins’ clients trusted him to manage their financial affairs, including distribution of assets among their designees. However, Jenkins betrayed that trust by transferring those funds into separate accounts for his own use.

U.S. Attorney Hayden P. O’Byrne for the Southern District of Florida and Special Agent in Charge Brett Skiles of the FBI Miami made the announcement, highlighting the importance of holding accountable individuals who abuse their positions of trust.

FBI Miami investigated the case, with Assistant United States Attorney Altanese Phenelus prosecuting it. During the sentencing hearing, Judge David S. Leibowitz emphasized the significance of holding accountable those with Bar cards, stating that they are uniquely situated to hold the public’s trust as licensed attorneys.

Jenkins’ sentence serves as a reminder that those who abuse their positions of trust will face severe consequences. The public can expect the highest level of integrity from the legal profession, and when that trust is broken, those responsible will be held accountable.
