FESTUS, MO – Jones Festus Development LLC and its owner, Lloyd Jones, were sentenced earlier this month for knowingly and negligently violating federal environmental regulations during a demolition project in Missouri. The case, brought by the Environmental Protection Agency (EPA), highlights the dangers of improper asbestos handling and the legal ramifications of failing to adhere to environmental safety protocols.
According to court documents, Jones Festus Development was contracted to demolish eight residential homes and three commercial properties to clear the way for a new Walgreens store. Prior to the commencement of demolition, local authorities alerted Jones to the presence of asbestos-containing materials (ACM) within the structures. Despite this notification, Jones proceeded with preparations for demolition without first addressing or safely removing the hazardous materials.
The EPA’s investigation revealed that Jones Festus Development failed to conduct the required asbestos inspections and obtain necessary permits before initiating demolition activities. This blatant disregard for established regulations put both workers and the surrounding community at risk of exposure to dangerous asbestos fibers, a known carcinogen. Asbestos exposure can lead to severe respiratory illnesses, including asbestosis, lung cancer, and mesothelioma.
On April 19, 2006, the defendants were formally charged with one count of knowingly violating the Toxic Substances Control Act (TSCA), specifically 15 U.S.C. 2615(b), and one count of negligently violating the Clean Air Act (CAA), codified as 42 U.S.C. 7413(c)(1). Both Jones Festus Development LLC and Lloyd Jones subsequently pled guilty to the charges outlined in the Informations filed by the prosecution.
Sentencing & Penalties
On July 7, 2006, the court handed down its sentences. Jones Festus Development LLC was placed on probation for 24 months and ordered to pay a special assessment fee of $400. Lloyd Jones, the owner and operator, received a 12-month probation sentence, a $25 special assessment fee, and a substantial federal fine of $20,000. The penalties reflect the severity of the violations and serve as a deterrent to other companies considering similar shortcuts.
