BOSTON, Massachusetts – A Brazilian man has been charged with reentering the United States after being deported. Jose Antonio Moreira Martins Desouza, 39, was indicted by a federal grand jury in Boston for one count of unlawful reentry of a deported alien.
According to the indictment, Desouza was previously deported from the United States on November 14, 2012. It is alleged that he illegally reentered the country sometime after his deportation.
Desouza was arrested on May 22, 2023, and detained by Immigration and Customs Enforcement on June 26, 2024. He is currently being held in federal custody.
The charge of unlawful reentry of a deported alien carries a maximum sentence of up to 20 years in prison, three years of supervised release, and a fine of up to $250,000. Sentences are imposed by a federal district court judge based on the U.S. Sentencing Guidelines and statutes that govern the determination of a sentence in a criminal case.
Assistant U.S. Attorney Luke A. Goldworm of the Major Crimes Unit is prosecuting the case. Acting United States Attorney Joshua S. Levy and Todd Lyons, Field Office Director, Boston, U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations made the announcement.
The defendant is presumed innocent until proven guilty beyond a reasonable doubt in a court of law. Desouza is scheduled to appear in federal court in Boston at a later date.
