CHARLOTTE, NC – A Charlotte mechanic has been sentenced to a year in federal prison for a scheme to falsify vehicle emissions inspections, federal prosecutors announced Tuesday. Jose Manuel Cabrera, 28, pleaded guilty to conspiracy and was sentenced by U.S. District Judge Robert J. Conrad, Jr. for defrauding North Carolina’s vehicle emissions testing program.
According to court documents, Cabrera, while employed at Carolina Tire & Auto in Pineville, engaged in “clean scanning” – a practice where a vehicle’s emissions data is fraudulently altered by connecting testing equipment to a different, compliant vehicle instead of the one being inspected. Between February 2011 and May 2012, Cabrera illegally passed 164 vehicles that would have otherwise failed emissions tests, charging customers $60 per fraudulent inspection.
The Scheme Uncovered
The fraudulent activity involved entering the information of the vehicle requiring inspection into the state database, but then performing the actual emissions test on a separate vehicle – one either undergoing repair at the shop or already completed and awaiting pickup. This allowed Cabrera to generate passing emissions certificates for vehicles that did not meet federal standards. The scheme was uncovered through a joint investigation by the U.S. Environmental Protection Agency (EPA), the North Carolina State Bureau of Investigation (NC SBI), and the North Carolina Division of Motor Vehicles License & Theft Bureau (NC DMV L&T).
Legal Ramifications and Penalties
Cabrera was charged with conspiracy, a violation of Title 18 U.S. Criminal Code, specifically 18 U.S.C. §371. He ultimately pled guilty to one count. The sentencing included 12 months of incarceration, followed by a three-year period of court-supervised release, during which he is prohibited from obtaining any license or conducting vehicle emissions testing. He was also ordered to pay a $10,000 federal fine and complete 100 hours of community service. Prosecutors noted that Cabrera’s sentence was enhanced due to his prior criminal history, including documented membership in the MS-13 gang.
Impact on Air Quality and Enforcement
The EPA emphasized the importance of accurate emissions testing in maintaining air quality, particularly in the Charlotte metropolitan area, which struggles to meet federal ozone standards. False emissions data undermines the effectiveness of the Clean Air Act, a federal law designed to protect public health and welfare by regulating air pollution. The North Carolina DMV L&T has suspended Carolina Tire’s Pineville service center from conducting emissions testing for ten years as a result of Cabrera’s actions.
Investigation and Prosecution
The investigation was a collaborative effort involving the EPA’s Criminal Investigation Division, the NC SBI’s Diversion and Environmental Crimes Unit, and the NC DMV License & Theft Bureau, with support from the North Carolina Division of Air Quality. Assistant U.S. Attorney Steven R. Kaufman prosecuted the case for the U.S. Attorney’s Office in Charlotte. The case highlights the ongoing commitment of federal and state agencies to combat environmental crimes and ensure compliance with air quality regulations.
