Defendant Faces Up to 20 Years in Prison for Deadly Crash
OKLAHOMA CITY – In a tragic turn of events, a Guatemalan national has been charged with illegal reentry after a vehicle crash resulted in the deaths of six people near Elk City, Oklahoma.
The defendant, JOSE PAXTOR-OXLAJ, 43, of Guatemala, was driving the vehicle that crashed on November 21, 2023, killing six of his passengers and leaving a seventh critically injured.
An investigation by Immigration and Customs Enforcement (ICE) revealed that Paxtor-Oxlaj had been previously ordered to be removed from the United States by an Immigration Judge on June 29, 2010, and had been removed from the country on July 9, 2010.
According to ICE investigators, Paxtor-Oxlaj did not have permission to reenter the United States after his prior deportation, making him a suspect in the illegal reentry case.
The case is the result of an investigation by the Department of Homeland Security, Homeland Security Investigations and the Oklahoma Highway Patrol, with the case being prosecuted by Assistant U.S. Attorneys Brandon Hale and Elizabeth Joynes.
The public is reminded that these charges are merely allegations, and that Paxtor-Oxlaj is presumed innocent unless and until proven guilty beyond a reasonable doubt.
If found guilty, Paxtor-Oxlaj could face up to 20 years in federal prison, depending on the extent of his criminal history.
