Failure to Register as a Sex Offender Strikes Again: Eagle Butte Man Charged
In a shocking turn of events, Joseph Paul Marshall, a 37-year-old resident of Eagle Butte, South Dakota, has been accused of failing to register as a sex offender. The charges, which were announced by U.S. Attorney Randolph J. Seiler, are a serious offense that carries severe penalties.
According to the indictment, Marshall knowingly failed to register and update his registration between February 1, 2016, and March 10, 2016, and again between March 20, 2016, and April 10, 2016. The maximum penalty upon conviction is up to 10 years in custody and/or a $250,000 fine, up to life of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The indictment alleges that Marshall, a person required to register under the Sex Offender Registration and Notification Act, deliberately avoided registering and updating his information. This is a serious breach of trust and a blatant disregard for the law.
Marshall appeared before U.S. Magistrate Daneta L. Wollmann on August 8, 2016, and pled not guilty to the Indictment. The investigation is being conducted by the U.S. Marshals Service, and Assistant U.S. Attorney Jay P. Miller is prosecuting the case.
Marshall was remanded to the custody of the U.S. Marshals Service pending trial. A trial date has not been set. The charges are merely an accusation, and Marshall is presumed innocent until and unless proven guilty.
