Tampa, FL – Josiah E. Hutton, a 60-year-old Winter Haven resident, has been convicted of a serious crime that has shaken the trust of the community. In a shocking turn of events, Hutton pleaded guilty to concealment of assets from a bankruptcy estate.
According to the evidence presented, Hutton was retained to represent a debtor who was planning to file for bankruptcy. In anticipation of filing a bankruptcy petition, Hutton received a settlement check, which was property of the debtor’s bankruptcy estate, and deposited it into his attorney escrow account. Hutton later prepared and certified the debtor’s bankruptcy petition, yet he failed to list the settlement check as an asset, thereby concealing the asset from creditors and the Bankruptcy Court.
This case is a stark reminder of the importance of honesty and transparency in the legal profession. As a trusted advisor, Hutton had a responsibility to act with integrity and uphold the law. Instead, he chose to prioritize his own interests over the needs of his clients.
The Federal Bureau of Investigation and the Florida Department of Law Enforcement conducted a thorough investigation into Hutton’s actions. Their tireless efforts have brought this case to a close and ensured that justice will be served.
Special Assistant United States Attorney Chris Poor is leading the prosecution of this case. His expertise and dedication to seeking justice have been instrumental in bringing Hutton to justice.
Hutton faces a maximum penalty of five years in federal prison. Sentencing has been set for June 5, 2017. The community will be watching closely as this case unfolds and awaiting the outcome.
