Chicago Man Pleads Guilty to Heroin Possession in Iowa

A Chicago man has pleaded guilty to heroin possession in Iowa after attempting to flush the illicit substance down a toilet at the Cedar Rapids Police Department.

Julius Montgomery, Jr., 48, was convicted of possession with intent to distribute heroin in a federal court in Cedar Rapids on February 29, 2016.

According to court documents, Montgomery was stopped by police on November 10, 2015 and searched for drugs. During the search, investigators noticed Montgomery was trying to conceal something, but he denied it. Montgomery was later taken to the Cedar Rapids Police Department for questioning and asked to use the bathroom. Despite the toilet being designed for prisoners and unable to be flushed from inside the room, Montgomery attempted to dispose of 23 individual packages of heroin, totaling 2.1 grams, in the toilet.

Montgomery also admitted in a plea agreement to selling heroin to confidential informants twice in 2014.

Montgomery faces a possible maximum sentence of 20 years in prison, a $1,000,000 fine, $100 in special assessments, and a lifetime of supervised release following any imprisonment. He remains in custody of the United States Marshal pending sentencing.

The case was investigated as part of the Organized Crime Drug Enforcement Task Force (OCDETF) program through a cooperative effort of the Cedar Rapids Police Department and the Drug Enforcement Administration (DEA) Task Force, consisting of the DEA; the Cedar Rapids Police Department; the Linn County Sheriff’s Office; the Marion Police Department; the Iowa City Police Department; and the Iowa Division of Narcotics Enforcement, and prosecuted by Assistant United States Attorney Dan Chatham.
