Keith Foster, 37, of New Orleans, is at the center of a federal drug and gun conspiracy that stretched from June to October 2015. Alongside co-defendants Kermoric Johnson, 33, and Thomas Marold, 52, Foster faces a six-count Indictment on charges tied to the distribution of heroin and illegal firearm possession. The case, unsealed yesterday, paints a grim picture of a tightly wound operation rooted in the city’s underground drug trade.
The Indictment alleges that Foster, Johnson, and Marold conspired to distribute heroin across New Orleans during the four-month span. Foster was additionally charged with possession with intent to distribute both heroin and methamphetamines—drugs that have fueled a rising tide of addiction and violence in the region. If convicted on these counts, each defendant could face up to 20 years in prison, a $1,000,000 fine, and a mandatory minimum of three years under supervised release.
But the charges go beyond narcotics. Foster and Johnson were also hit with counts of conspiracy to possess, and actual possession of, firearms in furtherance of a drug trafficking crime. On October 29, 2015, the two men were found in possession of a .22 caliber rifle and a 9mm semi-automatic handgun—weapons allegedly used to protect their operation. Conviction on these counts carries a minimum of five years in prison, to be served consecutively to any other sentence, with a maximum penalty of life behind bars, a $250,000 fine, and three years of supervised release.
Kermoric Johnson, 33, faces an additional count: illegal possession of a firearm by a convicted felon. His criminal history triggers enhanced penalties under the Federal Gun Control Act, deepening the legal peril he now faces. Authorities say the weapons were not incidental but central to the operation—tools of intimidation and enforcement in a high-stakes narcotics enterprise.
U.S. Attorney Kenneth A. Polite, who announced the charges, emphasized that the Indictment is an allegation, not a conviction. “The guilt of the defendants must be proven beyond a reasonable doubt,” Polite stated, underscoring the presumption of innocence. Still, the evidence gathered by federal and local agencies suggests a coordinated network operating in plain sight.
The investigation was spearheaded by the ATF New Orleans Division Office, with critical support from the St. Bernard Parish Sheriff’s Office and the New Orleans Police Department. Assistant U.S. Attorney Nolan D. Paige is leading the prosecution. As the case moves forward, it stands as another stark reminder of the lethal intersection between street-level drug trade and illegal firearms in southern Louisiana.
