Kelvin Henderson, Making False Statements During Firearm Purchases, Indiana 2021

INDIANAPOLIS, IN – Kelvin Henderson, 23, of Indianapolis, is headed to federal prison for a year after admitting to a brazen gun trafficking scheme that put firearms into the hands of individuals legally prohibited from owning them – including a high school student. Henderson pleaded guilty to making false statements during firearm purchases, a charge stemming from a months-long investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

According to court documents, between April 2 and April 26, 2021, Henderson repeatedly visited gun dealers in Indianapolis, Carmel, and Lebanon, purchasing a total of six Glock 9mm handguns and one Ruger AR-556. The sheer volume of purchases in a short period immediately raised red flags, indicative of “straw purchasing” – a tactic where someone legally able to buy guns acquires them for others who cannot. Henderson falsely claimed on federal transaction forms that he was the true buyer in each instance.

Surveillance footage captured Henderson handing off one of the purchased firearms to an accomplice immediately after leaving a gun store. The investigation revealed Henderson used Instagram to connect with and arrange purchases for two individuals, one of whom he identified as a student at an Indianapolis high school. This revelation underscores a disturbing trend: criminals are increasingly leveraging social media platforms to facilitate illegal gun sales and bypass background checks.

“Gun traffickers who put deadly weapons in the hands of people with no business having them fuel the epidemic of gun violence in our communities,” stated Zachary A. Myers, United States Attorney for the Southern District of Indiana. “Today’s gun traffickers are using Instagram and other social media platforms to illegally put guns in the hands of children and criminals. Together with our partners at ATF we will make our neighborhoods safer by targeting the sources of crime guns and holding illegal gun traffickers accountable.”

Daryl McCormick, Special Agent in Charge of the ATF, added, “Kelvin Henderson not only illegally purchased firearms, but he did so knowingly risking the lives of minors and the safety of our community. Straw purchasing is not a victimless crime and will not be tolerated.” Henderson’s sentence, handed down by U.S. District Court Judge Matthew P. Brookman, includes one year of supervised release following his prison term.

This case is part of the Department of Justice’s Project Safe Neighborhoods (PSN), a comprehensive program aimed at reducing violent crime and gun violence. The PSN strategy focuses on fostering community trust, supporting local violence prevention groups, prioritizing strategic enforcement, and meticulously tracking results. Assistant U.S. Attorney Lawrence D. Hilton prosecuted the case. The ATF’s Columbus Field Division led the investigation, highlighting the agency’s ongoing efforts to disrupt illegal firearms trafficking networks across the Midwest.
