Kevin Hamilton, Firearm Possession, New Orleans LA, 2023

NEW ORLEANS, LA – Kevin Hamilton, 27, of Marrero, Louisiana, is facing serious federal charges after allegedly being caught with a firearm in the heart of the French Quarter. The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and Louisiana State Police moved on the case, leading to an indictment handed down May 19, 2023.

Hamilton has been indicted on a single count of Possession of a Firearm by a Convicted Felon, a violation of Title 18, United States Code, Sections 922(g)(1) and 924(a)(8). This isn’t a first offense; Hamilton’s past felony convictions legally barred him from possessing any firearm. Details surrounding the initial discovery of the weapon have not yet been released.

If convicted, Hamilton could be looking at a lengthy prison sentence – up to fifteen years behind bars. Beyond incarceration, he faces a potential fine of up to $250,000, and up to three years of supervised release following his time in prison. A mandatory $100 special assessment fee will also be levied if he’s found guilty.

U.S. Attorney Duane A. Evans was quick to clarify that the indictment is merely an accusation. “The guilt of the defendant must be proven beyond a reasonable doubt,” Evans stated in a press release. The case will now proceed through the federal court system, where Hamilton will have the opportunity to defend himself against the charges.

This case is being touted as part of “Project Safe Neighborhoods” (PSN), a broad initiative aimed at reducing violent crime and gun violence nationwide. The Department of Justice launched a strengthened version of PSN in May 2021, focusing on building trust with communities, supporting local anti-violence organizations, and prioritizing strategic enforcement.

Assistant U.S. Attorney Stuart Theriot of the Narcotics Unit is leading the prosecution. The ATF and Louisiana State Police deserve credit for their work on this case. Grimy Times will continue to follow this case as it moves through the courts and report on any further developments.
