Defendant Convicted of Espionage in Virginia
A federal jury in Virginia convicted a former Central Intelligence Agency case officer, Kevin Patrick Mallory, of espionage charges related to his transmission of classified documents to an agent of the People’s Republic of China.
Mallory, 61, of Leesburg, was found guilty of sending sensitive information to Michael Yang, an individual he believed worked for the People’s Republic of China Intelligence Service, during a trip to Shanghai in 2017.
According to court records, Mallory met Yang in March and April 2017 and voluntarily handed over classified documents, which were later found to be stored on a Samsung Galaxy smartphone. The documents included information pertaining to the same U.S. government agency and one of them was classified TOP SECRET.
G. Zachary Terwilliger, U.S. Attorney for the Eastern District of Virginia, stated that there are few crimes in this country more serious than espionage, and that this conviction sends a message to anyone considering violating the public’s trust and compromising national security.
The prosecution presented evidence, including surveillance video from a FedEx store in Leesburg where Mallory was seen scanning the classified documents, and a recording from June 24, 2017, where Mallory was heard on a call from jail asking his family to search for a micro SD card containing the documents.
Nancy McNamara, Assistant Director in Charge of the FBI’s Washington Field Office, highlighted the serious threat to U.S. national security posed by foreign intelligence agents targeting former U.S. Government security clearance holders.
The conviction comes as the U.S. continues to face threats from foreign intelligence services, and serves as a reminder of the importance of protecting classified information.
Mallory’s sentencing hearing has not been scheduled yet.
