Employer Sued for Immigration Discrimination in California

Grimy Times has learned that Key Fortune, Inc., doing business as Express Employment Professionals, has agreed to settle a discrimination lawsuit filed by the U.S. government in California. The company, based in Rancho Cucamonga, California, allegedly discriminated against a worker due to her immigration status.

According to the U.S. government, Key Fortune, Inc. refused to honor a valid document showing the worker’s permission to work in the United States. The company also reportedly refused to assign the worker to a job until she presented a specific document showing her future permission to work.

The government’s investigation, conducted by the Civil Rights Division’s Immigrant and Employee Rights Section (IER), found that Key Fortune, Inc. had engaged in unlawful discrimination by refusing to honor the worker’s valid documentation. The company’s actions were in violation of the Immigration and Nationality Act, which prohibits employers from requiring specific documents or rejecting valid documents that show an individual’s permission to work.

The settlement requires Key Fortune, Inc. to pay civil fines to the U.S. government and provide back pay to the affected worker. The company must also train its staff on the requirements of the Immigration and Nationality Act and update its employment policies. The U.S. government will also have the opportunity to monitor the company’s compliance with the law.

The IER is responsible for enforcing the antidiscrimination provisions of the Immigration and Nationality Act. The law prohibits employers from discriminating against workers based on their citizenship status, national origin, or immigration status.

A spokesperson for the U.S. government stated, ‘It is illegal for an employer to require a specific document or to reject a valid document that shows an individual’s permission to work, due to their immigration status.’

The IER offers resources to help employers avoid unlawful discrimination when verifying a worker’s permission to work. Those who believe they have been discriminated against due to their immigration status can file a complaint with the IER. The public can also contact the IER’s worker hotline at 1-800-255-7688 (TTY for individuals with hearing disabilities) or the employer hotline at 1-800-255-8155 (TTY for individuals with hearing disabilities).
