LaRoche Sentenced for Assaulting Officer
A Lower Brule, South Dakota man has been sentenced to prison for his role in a violent altercation with a federal officer.
On May 29, 2013, U.S. District Judge Roberto A. Lange handed down a sentence of 12 months and 1 day of imprisonment to Elmer LaRoche, 26, for assaulting, resisting and impeding a federal officer.
According to court documents, the incident occurred on November 1, 2012, at a home in Lower Brule. LaRoche, who was intoxicated, refused to leave the premises despite a tribal court order that prohibited intoxicated individuals from entering the house.
A tribal officer was dispatched to the residence and attempted to arrest LaRoche, but he resisted and struggled with the officer. During the altercation, LaRoche struck the officer in the head with a metal can.
LaRoche was indicted by a federal grand jury on December 11, 2012. Assistant U.S. Attorney Meghan N. Dilges prosecuted the case, which was investigated by the Bureau of Indian Affairs.
As part of his sentence, LaRoche was also ordered to pay a $100 special assessment to the Federal Crime Victims Fund. He will serve 2 years of supervised release following his imprisonment. LaRoche was immediately turned over to the custody of the U.S. Marshals Service.
The violent altercation serves as a stark reminder of the dangers faced by law enforcement officers in the line of duty.
