BROOKINGS, SOUTH DAKOTA – A Minnesota man’s reckless disregard for his child’s well-being has finally caught up with him.
Larry T. Davis, 38, was sentenced to two years of probation for failure to pay legal child support, leaving his minor child in South Dakota to suffer the financial consequences of his actions.
According to court documents, Davis was indicted by a federal grand jury on December 4, 2012, for failing to pay over $11,774 in child support. The past due obligation was imposed on January 1, 2010, by the Third Judicial Circuit Court, Brookings County, South Dakota, and went unpaid for more than one year.
As the court proceedings revealed, Davis was residing in Minnesota while his minor child remained in South Dakota, making it all the more egregious that he willfully and unlawfully failed to pay this past due child support obligation. His reckless behavior has finally come to an end, with Davis pleading guilty to the charge on April 12, 2013.
The court’s decision serves as a timely reminder that the failure to pay child support is a serious offense with severe consequences. In addition to the two years of probation, Davis was also ordered to pay a $10 special assessment to the Federal Crime Victims Fund and child support restitution in the amount of $12,974.00.
The case was investigated by the Department of Health and Human Services, Office of Inspector General, with Assistant U.S. Attorney Thomas J. Wright prosecuting the case.
In a statement, U.S. Attorney Brendan V. Johnson emphasized the importance of upholding the law and protecting the rights of families who rely on child support payments. It is clear that Larry T. Davis’s actions have caused irreparable harm to his child, and it is imperative that we hold individuals accountable for their failure to provide for their loved ones.
