Minnesota Man Sentenced for Failure to Pay Child Support

A Marshall, Minnesota man has been held accountable for his egregious failure to pay child support to his minor child in South Dakota.

Larry T. Davis, 38, was sentenced to 2 years of probation, a $10 special assessment to the Federal Crime Victims Fund, and child support restitution in the amount of $12,974.00 by U.S. Magistrate Court Judge John E. Simko on May 3, 2013.

Davis was indicted for failing to pay over $11,774.00 in child support by a federal grand jury on December 4, 2012. The past due child support obligation was imposed on Davis by the Third Judicial Circuit Court, Brookings County, South Dakota, for the benefit of his minor child, effective on or about January 1, 2010.

The court found that Davis willfully and unlawfully failed to pay this past due child support obligation, which exceeded $5,000, for over a year. This egregious failure occurred while Davis resided in Minnesota and his minor child remained in South Dakota.

Davis pled guilty to the charge of Failure to Pay Legal Child Support on April 12, 2013.

The case was investigated by the Department of Health and Human Services, Office of Inspector General. Assistant U.S. Attorney Thomas J. Wright prosecuted the case.
