Lower Brule Man Charged with Assaulting Federal Officer

A 19-year-old man from Lower Brule, South Dakota, has been indicted for allegedly assaulting a federal officer. Malcolm Andrews, 19, was charged with Assaulting, Resisting and Impeding a Federal Officer by a federal grand jury on July 17, 2013.

According to court documents, Andrews appeared before U.S. Magistrate Judge Mark A. Moreno on August 22, 2013, and pled not guilty to the Indictment. If convicted, he faces a maximum penalty of 20 years of imprisonment, a $250,000 fine, or both; 3 years of supervised release and an additional 2 years of supervised release upon revocation; and a mandatory $100 special assessment to the Federal Crime Victims Fund. Restitution may also be ordered.

The charge is merely an accusation, and Andrews is presumed innocent until and unless proven guilty. The investigation is being conducted by the Bureau of Indian Affairs, with Assistant U.S. Attorney Meghan N. Dilges prosecuting the case.
