Alien Smuggling and Fraud Charges Hit Georgia Residents

ATLANTA – In a shocking display of deceit and exploitation, two Honduran nationals have been indicted on alien smuggling and fraud charges in the Northern District of Georgia.

Luis Adolfo Mendoza Fonseca, 30, and his sister Rosmery Yambiel Castillo Fonseca, 25, allegedly orchestrated a scheme to smuggle an unaccompanied alien child (UAC) into the United States, exploiting a 15-year-old girl for personal gain.

The indictment alleges that Mendoza Fonseca and Castillo Fonseca encouraged and induced the UAC to travel to the United States, paying for her travel and providing her with a false identity to use when she entered the country.

According to court documents, the purpose of using the false identity was to enable Castillo Fonseca to sponsor the UAC, who was actually Mendoza Fonseca’s online romantic partner. Castillo Fonseca submitted an application to the Office of Refugee Resettlement (ORR) under penalty of perjury to sponsor and obtain custody of the UAC.

However, when staff at an HHS-funded care provider questioned the authenticity of the sponsorship application, Mendoza Fonseca and Castillo Fonseca admitted to having a romantic online relationship with the UAC.

The indictment charges Mendoza Fonseca and Castillo Fonseca with conspiracy to encourage and induce an alien to come to, enter, and reside in the United States, aiding and abetting the encouragement and inducement of an alien to come to, enter, and reside in the United States for the purpose of commercial advantage and private financial gain, and aiding and abetting making a false, fictitious, or fraudulent statement or representation to an officer or employee of the United States.

The U.S. Attorney’s Office and law enforcement agencies are committed to protecting vulnerable children from exploitation and ensuring that those who commit crimes against them are held accountable.

Luis Adolfo Mendoza Fonseca and his sister Rosmery Yambiel Castillo Fonseca are expected to face trial in the coming months.
