Luis Fernando Diaz-Garcia, Illegal Re-entry, Pennsylvania 2024

PITTSBURGH, Pa. – In a shocking turn of events, local authorities have brought to light a disturbing case of illegal re-entry into the United States. Luis Fernando Diaz-Garcia, a 27-year-old citizen of Honduras, has been indicted by a federal grand jury in Pittsburgh on a charge of illegal re-entry of a removed alien, announced Acting United States Attorney Troy Rivetti.

The one-count Indictment named Diaz-Garcia as the sole defendant. According to the Indictment, in August 2024, Diaz-Garcia was found in western Pennsylvania after having been removed from the United States on or about November 13, 2019. This raises serious questions about the effectiveness of our nation’s immigration policies.

Public records show that Diaz-Garcia was charged by criminal complaint in Allegheny County by the Pennsylvania State Police for conduct allegedly occurring on or about August 19, 2024. The law provides for a maximum total sentence of up to two years in prison, a fine of up to $250,000 or both.

Under the federal Sentencing Guidelines, the actual sentence imposed would be based upon the seriousness of the offense and the prior criminal history of the defendant. Assistant United States Attorney Rebecca L. Silinski is prosecuting this case on behalf of the United States.

U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations conducted the investigation leading to the Indictment. An indictment is an accusation. A defendant is presumed innocent unless and until proven guilty.
