WASHINGTON D.C. – Tucker Weston, 35, of Lynnwood, Washington, will spend the next two years behind bars after being sentenced for his role in the January 6th, 2021, assault on the U.S. Capitol. Weston pleaded guilty to two felony charges – civil disorder and assaulting, resisting, or impeding certain officers – and received a 24-month prison sentence, followed by 36 months of supervised release. U.S. District Judge Reggie B. Walton also ordered Weston to pay $2,000 in restitution.
Court documents detail Weston’s journey from Seattle to Washington, D.C., where he attended the “Stop the Steal” rally, fueled by false claims of a stolen 2020 presidential election. Following the rally, Weston joined the mob marching towards the Capitol, actively participating in the initial breach by helping to remove metal barricades. This act directly enabled the rioters to advance on the building and disrupt the joint session of Congress convened to certify the electoral votes.
The violence escalated quickly. Weston didn’t just observe; he actively engaged. He shoved officers attempting to hold the line, even as they deployed oleoresin capsicum (OC) spray in a desperate attempt to control the crowd. Moving to the south side of the West Plaza, Weston continued to assault officers, joining other rioters in physically impeding law enforcement. He then adopted an aggressive stance, fist clenched, and continued yelling obscenities at the police – “Come on” and “F— you” – while refusing to heed orders to retreat despite being sprayed with OC spray. He then joined in using a bike rack to push against law enforcement.
Weston’s rampage didn’t stop at physical assault. He breached the Capitol building itself, entering through a broken window near the Senate Wing Door before quickly exiting. He then moved to the North Portico, where he was removed by law enforcement, before joining a group vandalizing media equipment, kicking and smashing it alongside fellow rioters. He even accepted a bag of stolen equipment from another rioter before fleeing the scene.
The FBI finally apprehended Weston on October 19, 2022, in his hometown of Lynnwood, Washington. The investigation, a joint effort between the Seattle and Washington Field Offices, had identified Weston as BOLO AFO (Be on the Lookout Assault on Federal Officer) #437. This case, prosecuted by the U.S. Attorney’s Office for the District of Columbia and the Department of Justice National Security Division’s Counterterrorism Section, with assistance from the U.S. Attorney’s Offices for the Western District of Washington, serves as a stark reminder that those who attacked the Capitol will be held accountable.
For two hours on the West Plaza – described in court documents as one of the most violent areas of the Capitol on January 6th – Weston witnessed and participated in a chaotic scene of violence, where rioters pushed, punched, and pepper-sprayed officers. The sentencing of Weston underscores the severity of the crimes committed that day and the ongoing commitment of federal authorities to bring all perpetrators to justice.
