Madison County, NY Faces ADA Violations, Agrees to Settlement

State authorities announced an agreement with Madison County, New York, to address accessibility issues that violate the Americans with Disabilities Act (ADA). The agreement marks the 25th anniversary of the ADA and is part of the Department of Justice’s Project Civic Access (PCA) initiative.

Under the agreement, Madison County is required to make its communications with people with disabilities as effective as those with people without disabilities. This includes providing documents in alternative formats such as Braille, large print, recordings, and accessible electronic formats. The county is also obligated to reasonably modify its policies, practices, and procedures to ensure equal access to its programs, services, and activities.

County employees will receive training on the requirements of the ADA and appropriate ways of serving people with disabilities. Chris Rifendifer, a resident who is legally blind, will benefit from this agreement. Rifendifer, who relies on Medicaid and food stamps, was previously provided with forms he could not read or complete, and was denied assistance when he asked for help.

Experiences like Rifendifer’s will become a thing of the past under the PCA agreement. Rifendifer shared his story on the Justice Department blog, highlighting the impact of PCA agreements on the everyday lives of people with disabilities.

The settlement agreement requires Madison County to comply with the ADA’s architectural accessibility requirements by remediating existing buildings, building new ones, and altering existing structures. The county must also publish and distribute ADA information, use the New York telephone relay service to communicate with individuals who are deaf or hard-of-hearing, conduct ADA training, and submit to monitoring of its compliance with the agreement.
