Michael Tobacco, Assault with a Dangerous Weapon, South Dakota 2013

A disturbing case of domestic violence has shaken the community of Pine Ridge, South Dakota, as 21-year-old Michael Tobacco stands accused of assaulting his girlfriend.

According to sources, Tobacco allegedly slapped, punched, and kicked his girlfriend at Pine Ridge, leaving her with substantial bodily injuries. The brutal attack has left many in the community reeling and demanding justice for the alleged victim.

On August 27, 2013, a federal grand jury indicted Tobacco on two counts: Assault with a Dangerous Weapon and Assault Resulting in Substantial Bodily Injury to an Intimate Partner or Dating Partner.

The maximum penalty for conviction is 10 years’ imprisonment and/or a $250,000 fine. The charges are merely an accusation, and Tobacco is presumed innocent until proven guilty in a court of law.

The investigation is being conducted by the Bureau of Indian Affairs Office of Justice Services and the Oglala Sioux Tribe Department of Public Safety. Assistant U.S. Attorney Eric Kelderman is prosecuting the case.

Tobacco, who appeared before U.S. Magistrate Judge Veronica L. Duffy on September 11, 2013, pled not guilty to the indictment. He was subsequently remanded to the custody of the U.S. Marshals Service, awaiting a trial date that has yet to be set.
