The streets of Eagle Butte, South Dakota, got a whole lot darker last July when 50-year-old John Maynard allegedly struck a victim with a closed fist, landing himself in hot water with federal authorities.
According to sources close to the investigation, Maynard, a resident of Eagle Butte, is facing charges of Assault by Striking, Beating and Wounding, a serious offense that could land him behind bars for up to 1 year, result in a hefty fine of $100,000, or both. The alleged incident, which took place in July 2013, left the victim with wounds that still linger to this day.
Maynard, who was taken into custody by the U.S. Marshals Service, appeared before U.S. Magistrate Judge Mark A. Moreno on July 26, 2013, where he pleaded not guilty to the charge. His trial is set for September 24, 2013, and could mark the beginning of the end for the 50-year-old defendant.
The investigation into the alleged assault is being led by the Cheyenne River Sioux Tribe Law Enforcement Services, with Assistant U.S. Attorney Mikal Hanson at the helm. Hanson is tasked with proving the federal government’s case against Maynard, a challenge that won’t be easy given the gravity of the charges.
Maynard’s defense team will likely argue that their client is innocent until proven guilty, a principle that’s been upheld in the United States for centuries. But with the evidence mounting against him, it remains to be seen whether Maynard will be able to beat the rap.
The maximum penalty for conviction on the charge of Assault by Striking, Beating and Wounding includes up to 1 year of supervised release and $25 to the Federal Crime Victims Fund. Restitution may also be ordered, a reminder that in the eyes of the law, victims have the right to be compensated for their suffering.
The case is a stark reminder that violent crime has no place in our society, and that those who commit such acts must be held accountable for their actions. As this story continues to unfold, one thing is certain: justice will be served, and the people of Eagle Butte will be watching with bated breath.
