Jason Riley, Assault Resulting in Serious Bodily Injury, South Dakota 2013

A brutal assault on the Rosebud Sioux Indian Reservation has led to a guilty plea from a local man. Jason Riley, 36, of Rosebud, South Dakota, appeared before U.S. District Judge Roberto A. Lange on November 19, 2013, and pled guilty to Assault Resulting in Serious Bodily Injury.

According to the U.S. Attorney’s office, the maximum penalty upon conviction is 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund.

The violent incident occurred on October 13, 2010, at the Sicangu Village Housing on the Rosebud Sioux Indian Reservation. The victim approached Riley and asked for a cigarette, but the situation quickly turned ugly. A verbal disagreement ensued, and Riley struck the victim in the face and kicked the victim with his shod feet while the victim was on the ground.

The victim suffered multiple abrasions, soft tissue bruising, and a nose bone fracture as a result of the brutal attack. The investigation was conducted by the Rosebud Sioux Tribe Law Enforcement Services, who worked tirelessly to bring the perpetrator to justice.

Assistant U.S. Attorney Tim Maher is leading the prosecution in this case. A presentence investigation has been ordered, and a sentencing date has been set for February 10, 2014. Riley was released pending sentencing.
