Man Charged with Assault with Shod Feet
A Little Eagle, South Dakota, man is facing federal charges for assaulting his girlfriend with his shod feet.
34-year-old Gary Little Bird, Jr. was indicted on March 11, 2014, by a federal grand jury on charges of Assault with a Dangerous Weapon and Domestic Assault by an Habitual Offender.
According to the indictment, the assault occurred on or about February 13, 2014. Little Bird appeared before U.S. Magistrate Judge William D. Gerdes on March 18, 2014, and pled not guilty to the indictment.
The maximum penalty upon conviction is up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and up to $200 to the Federal Crime Victims Fund. Restitution may also be ordered.
The investigation is being conducted by the Bureau of Indian Affairs. Assistant U.S. Attorney Troy R. Morley is prosecuting the case.
Little Bird was remanded to the custody of the U.S. Marshals Service pending trial. A trial date has not been set. The charge is merely an accusation, and Little Bird is presumed innocent until and unless proven guilty.
