Man Convicted of South Dakota Domestic Assault Sentenced

Harrold, SD native Ervin Yellow Robe, 41, has been handed a harsh sentence for his brutal assault of an intimate partner. Acting United States Attorney Dennis Holmes announced that Yellow Robe was sentenced to 32 months in federal prison, plus three years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund by Chief Judge Roberto A. Lange on November 29, 2021.

The incident, which led to this severe punishment, transpired on March 1, 2020, when Yellow Robe inflicted substantial bodily injury upon his partner in Big Bend, South Dakota, breaking her nose. After pleading guilty on July 29, 2021, to Assault Resulting in Substantial Bodily Injury to an Intimate Partner, Yellow Robe faced the consequences of his violent actions.

Yellow Robe was indicted by a federal grand jury on October 14, 2020. The case against him was investigated by the Federal Bureau of Investigation and the Bureau of Indian Affairs – Office of Justice Services, Crow Creek Agency. Assistant U.S. Attorney Troy R. Morley prosecuted the case with vigor.

Upon conviction, Yellow Robe was immediately turned over to the custody of the U.S. Marshals Service, ensuring that he would no longer pose a threat to society or his victims.

This sentencing serves as a stark reminder of the serious nature of domestic violence and the lengths to which the justice system will go to protect innocent victims from such heinous acts.
