Man Sentenced for Assault with a Dangerous Weapon

A Mission, South Dakota man has been sentenced to 84 months in custody for a violent crime that took place in December 2013.

According to court documents, Rigoberto Ortiz, 45, pounded and kicked at the door of a residence, firing two shots outside before forcing his way inside. Once inside, Ortiz held a weapon to the neck/throat of one victim and the forehead of another.

Ortiz was initially indicted on charges of First Degree Burglary, Assault with a Dangerous Weapon, Use of a Firearm During a Crime of Violence, and Possession with Intent to Distribute a Controlled Substance. He eventually pled guilty to Assault with a Dangerous Weapon on May 13, 2014.

The investigation was led by the Rosebud Sioux Tribe Law Enforcement Services, and the case was prosecuted by Assistant U.S. Attorney Jay Miller. Ortiz was remanded to the custody of the U.S. Marshals Service to begin serving his 84-month sentence.

As part of his sentence, Ortiz was also ordered to pay a $100 special assessment to the Federal Crime Victims Fund and to forfeit a .45 caliber Glock.

U.S. Attorney Brendan V. Johnson made the announcement of Ortiz’s sentencing, which took place on July 28, 2014, before U.S. District Judge Roberto A. Lange.
