Brett Roach, Assault Resulting in Serious Bodily Injury, South Dakota 2015

A McLaughlin man has been sentenced to 10 years in prison for severely injuring a 10-month-old child in his care. Brett Roach, 27, was found guilty of Assault Resulting in Serious Bodily Injury after a two-day trial in Pierre, South Dakota.

According to court documents, Roach was babysitting his wife’s three young children on May 22, 2013, when he forcefully threw one of the children off the bed and across the room. The child suffered severe head injuries, including bilateral skull fractures and subdural hematomas, as well as multiple bruises over various parts of the body.

Roach called 911 after noticing the child was unconscious and was airlifted to Sanford USD Medical Center in Sioux Falls due to the severity of the injuries. The child was in critical condition for an extended period of time.

Roach was indicted by a federal grand jury on June 6, 2013, and was sentenced to 120 months in custody, 2 years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund by U.S. District Judge Charles B. Kornmann on January 5, 2015.

The case was investigated by the Federal Bureau of Investigation and the Bureau of Indian Affairs, Standing Rock Agency. Assistant U.S. Attorney Troy R. Morley prosecuted the case.

Roach was immediately turned over to the custody of the U.S. Marshals Service to begin serving his sentence. His conviction serves as a reminder of the severity of child abuse and the consequences of such actions.
