Assault in Indian Country Lands Albuquerque Man 5 Years in Prison

A 32-year-old man from Albuquerque, New Mexico, has been sentenced to five years in prison for his role in a brutal assault on an Indian child in 2014.

Patrick Duran, who was previously a resident of Dulce, New Mexico, pleaded guilty to assault resulting in serious bodily injury in Indian Country on August 26, 2020. In his plea agreement, Duran admitted to assaulting John Doe, an Indian child, on September 28, 2014, by acting roughly with him and causing him to suffer serious bodily injuries including internal head injuries, seizures, and hospitalization.

The assault took place on the Jicarilla Apache Indian Reservation in Rio Arriba County, New Mexico. Duran, a non-Indian, was subsequently arrested and charged in federal court.

According to the FBI and local law enforcement, the investigation into the assault was a collaborative effort between the Farmington Resident Agency of the FBI Albuquerque Field Office and the Jicarilla Apache Police Department.

Assistant U.S. Attorneys Kyle Nayback and Nicholas Marshall prosecuted the case, bringing Duran to justice for his brutal crime. Upon his release from prison, Duran will be subject to three years of supervised release.
