Marcos D. Guzman, Gun Store Burglary, New York 2018

A brazen burglary at a Rochester gun store has landed a local man in hot water. Marcos D. Guzman, 35, pleaded guilty to theft of firearms from a Federal Firearms Licensee and possession of firearms by a convicted felon before U.S. District Judge Elizabeth A. Wolford.

According to authorities, Guzman, along with co-defendants Dakota Sarfaty and Luis D. Marcano-Agosto, broke into Chinappi’s Firearms & Supplies, a gun store located at 5016 West Ridge Road, Spencerport, New York, in the early morning hours of August 16, 2018. Sarfaty entered the basement through a hole in the wall and, together with Guzman and Marcano-Agosto, stole a total of approximately 87 firearms (almost all of which were handguns).

The stolen firearms were then sold on the streets of Rochester. Law enforcement recovered 14 of the stolen firearms the day after the theft.

The plea is the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms & Explosives, under the direction of Special Agent-in-Charge Ashan Benedict, New York Field Division, the Monroe County Sheriff’s Office, under the direction of Sheriff Todd K. Baxter and the Rochester Police Department, under the direction of Chief La’Ron D. Singletary.

Under the terms of the plea agreement, Guzman faces a maximum penalty of 10 years in prison and a $250,000 fine.

Sentencing is scheduled for July 29, 2019, at 2:00 p.m. before Judge Wolford.
