Sioux City Woman Pleads Guilty to Multiple Firearm Violations

A woman in Sioux City, Iowa, has been convicted of multiple firearm-related crimes after a guilty plea in federal court. Maria Francisca Portalatin, 53, was found guilty of being a prohibited person in possession of firearms, making false statements during the purchase of firearms, straw purchase of firearms, and concealing a person from arrest.

The charges stem from a series of incidents in 2023 and 2024, during which Portalatin allegedly made false statements and representations on ATF forms while purchasing multiple firearms at Dunham’s Sports Store in Sioux City. In addition to lying on the forms, Portalatin admitted to law enforcement that she was an unlawful user of methamphetamine and purchased the firearms for Freddie Summerville, who was prohibited from possessing a firearm.

On multiple occasions, Portalatin lied on ATF forms, claiming that the firearms were for her use when in fact they were for Summerville. In January 2024, a Sioux City Police stop of a car driven by Summerville but owned by Portalatin resulted in the discovery of one of the firearms. Further investigation led to the discovery of additional firearms purchased by Portalatin.

Portalatin’s guilty plea included admissions that she was aware that Summerville was wanted on a federal warrant and that she had helped harbor and conceal him. In July 2024, Portalatin and Summerville were stopped in a vehicle near Sioux Falls, and Portalatin admitted to law enforcement that they were smoking methamphetamine.

Portalatin remains free on bond, pending sentencing, which is expected to be set after a presentence report is prepared. She faces a possible maximum sentence of 15 years’ imprisonment, a $250,000 fine, and 3 years of supervised release following any imprisonment.

The case was prosecuted by Assistant United States Attorney Kevin C. Fletcher and was investigated by the Sioux City Police Department and the Bureau of Alcohol, Tobacco and Firearms (ATF). The case file number is 24-CR-04053, and court file information can be found at https://ecf.iand.uscourts.gov/cgi-bin/login.pl.

The investigation and prosecution of this case highlight the importance of enforcing federal firearms laws and holding individuals accountable for their actions. The Bureau of Alcohol, Tobacco and Firearms will continue to work with law enforcement agencies to prevent the diversion of firearms into the wrong hands and to bring individuals to justice who violate federal firearms laws.
