San Diego Tax Preparer Sentenced for Tax Fraud
A San Diego tax return preparer has been brought to justice for her role in a large-scale tax fraud scheme. Marla Lynn Cunningham, owner of Cunningham’s Tax Service, was sentenced to 37 months in prison for preparing fraudulent tax returns.
According to documents filed with the court, Cunningham operated her tax preparation business in El Cajon, California, from 2010 through 2012. During this time, she prepared fraudulent returns for her clients that reported fake business losses, charitable contributions, and medical, dental, education and unreimbursed employee expenses.
The scheme caused a significant tax loss of approximately $1,237,943. In addition to the prison sentence, Cunningham was ordered to serve one year of supervised release and pay $91,867 in restitution to the Internal Revenue Service (IRS).
Cunningham pleaded guilty in December 2016 to three counts of preparing false tax returns. The case was investigated by special agents of IRS–Criminal Investigation and prosecuted by Trial Attorneys Matthew R. Hoffman and Benjamin J. Weir of the Tax Division.
