Brian Kirk Marshall, a man who opened fire on FBI agents attempting to arrest him in Delaware County last October, has pleaded guilty to assaulting federal officers. The 50-year-old from Pattonsburg, Missouri, also admitted obstruction of justice and using a firearm during a violent crime.
Marshall’s plea came before U.S. District Judge Claire V. Eagan, who scheduled sentencing for August 27, 2019.
In an incident that unfolded in rural northeastern Oklahoma, Marshall, a self-proclaimed ‘cop killer’, opened fire on FBI agents after they identified themselves and tried to evacuate the residence peacefully. After more than 40 minutes of negotiation, Marshall was finally taken into custody, according to U.S. Attorney Trent Shores.
Marshall confessed during the plea hearing that he fired eight rounds at the FBI agents after they attempted a search warrant on his residence. The incident also involved an arrest warrant for interstate communication of threats he allegedly made against law enforcement officers.
The FBI returned fire in accordance with their protocol, leading to Marshall’s surrender. The U.S. Marshals Service currently holds Marshall in custody while awaiting sentencing.
Assistant U.S. Attorney Robert T. Raley is the lead prosecutor for this case and serves as the National Security Anti-Terrorism Prosecutor for the Northern District of Oklahoma.
