Marvin Flythe, Tax Return Preparer Guilty, North Carolina 2015

A North Carolina tax return preparer has pleaded guilty to preparing and filing false tax returns with the IRS, announced Principal Deputy Assistant Attorney General Caroline D. Ciraolo and U.S. Attorney Ripley Rand.

Marvin Flythe, 53, admitted that he ran a tax preparation business in Greensboro, North Carolina, called "TAXHOVA." Between January 2012 and January 2015, Flythe admitted preparing and filing numerous individual income tax returns for clients on which he reported false business losses and false unreimbursed employee business expenses.

Flythe maintained a YouTube video channel on which he advertised TAXHOVA. Flythe admitted to filing at least 36 false returns for clients, for which $130,949 in fraudulent refunds were paid. Flythe also admitted to filing false personal returns for himself for tax years 2011, 2012 and 2013 and to failing to file his 2014 return.

Flythe is scheduled to be sentenced on Nov. 14. He faces a statutory maximum sentence of three years in prison for each count of aiding and assisting in the preparation of false tax returns, as well as a term of supervised release and monetary penalties.

Principal Deputy Assistant Attorney General Ciraolo and U.S. Attorney Rand commended special agents of Internal Revenue Service Criminal Investigation, who investigated the case, and Trial Attorney Robert J. Boudreau of the Tax Division and Assistant U.S. Attorney Anand Ramaswamy of the Middle District of North Carolina, who are prosecuting this case.

Flythe’s actions demonstrate a blatant disregard for the law and a willingness to deceive the IRS for personal gain. His guilty plea is a significant blow to those who engage in such illegal activities.

The case against Flythe serves as a reminder that the IRS and its law enforcement partners will continue to investigate and prosecute those who engage in tax-related crimes.
