Matthew Ware, a former supervisory corrections officer at the Kay County Detention Center in Newkirk, Oklahoma, is facing federal charges for abusing his power and violating the constitutional rights of multiple pretrial detainees. A three-count indictment returned by a federal grand jury alleges Ware deliberately placed inmates in harm’s way and used restraints in a brutal, unjustified manner—acts that resulted in serious bodily injury.

The first incident dates to May 18, 2017, when Ware ordered subordinates to move two detainees, identified only as D.W. and M.M., into a cell row occupied by known violent inmates. According to the indictment, Ware knew these inmates posed a clear threat, yet he directed officers to unlock D.W.’s and M.M.’s cells simultaneously with those of the aggressors. The resulting assault left both men injured—direct consequences of Ware’s reckless command.

Less than a year later, on January 31, 2018, Ware is accused of violating the rights of another pretrial detainee, referred to as C.D., by ordering jail staff to apply restraints in an unreasonable and dangerous fashion. C.D. suffered bodily injury during the restraint, the indictment states, marking a pattern of conduct in which Ware used his authority to inflict harm rather than maintain safety and order.

Ware is charged with three counts of federal civil rights violations, each carrying a maximum penalty of 10 years in prison, three years of supervised release, and a fine of up to $250,000. The charges stem from actions taken while he was in an official capacity at the Kay County Detention Center, where he oversaw corrections operations and wielded significant control over inmate treatment.

The FBI’s Oklahoma City Field Office led the investigation, underscoring the seriousness of the allegations within the federal justice framework. Prosecution is being handled by Assistant U.S. Attorney Julia Barry of the Western District of Oklahoma and Trial Attorney Laura Gilson of the Justice Department’s Civil Rights Division, signaling a top-level push to hold public officials accountable for misconduct behind bars.

An indictment is not a conviction. Matthew Ware is presumed innocent unless proven guilty in a court of law. But the charges paint a damning picture of abuse within a small-town jail system where oversight failed, and power was weaponized against the vulnerable. The case continues.
