McLaughlin Man Sentenced For Assault

A 22-year-old man from McLaughlin, South Dakota, has been sentenced to 6 months in custody for his role in a violent assault.

Brett Claymore was convicted of Assault by Striking, Beating, and Wounding and was sentenced on April 27, 2015, by U.S. District Judge Charles B. Kornmann.

According to court documents, Claymore, who was 22 years old at the time of the incident, refused to comply with instructions from a Corson County Sheriff’s Deputy. The deputy had been attempting to detain the driver of a four-wheeler in McLaughlin, but the driver fled and ran into a private residence.

Claymore was among a group of people in the living room of the residence when the deputy arrived. Despite instructions to sit on the floor, Claymore refused and pulled his arm away from the deputy. The two began to scuffle, but the deputy eventually broke free and handcuffed Claymore.

Claymore was indicted by a federal grand jury on June 17, 2014, and pleaded guilty on November 3, 2014. He was sentenced to 6 months in custody, 1 year of supervised release, and a $25 special assessment to the Federal Crime Victims Fund.

The case was investigated by the Bureau of Indian Affairs, Standing Rock Agency, and prosecuted by Assistant U.S. Attorney Troy R. Morley. Claymore is scheduled to self-report to the U.S. Marshals Service by May 12, 2015.
