February 5, 2013 – Eagle Butte, SD. Isiah Mesteth, 22, of Eagle Butte, has been found guilty of Assault Resulting in Serious Bodily Injury. The maximum penalty upon conviction is 10 years of imprisonment, a $250,000 fine, or both; 3 years of supervised release and an additional 2 years of supervised release upon revocation.
The assault occurred on October 4, 2011 when Mesteth and his significant other got into an argument. Mesteth allegedly hit his significant other in the face and head several times, causing her nose and lips to bleed, as well as bruising and swelling to her face and arms.
The Bureau of Indian Affairs conducted the investigation and Assistant U.S. Attorney Kathryn N. Rich is prosecuting the case. Mesteth was remanded to the custody of the U.S. Marshal pending sentencing.
Mesteth’s sentencing date has been set for April 29, 2013. The seriousness of the crime and the potential sentence have left many in the community shaken.
As the case moves forward, it is clear that Mesteth’s actions have had severe consequences. The victim, who wishes to remain anonymous, has been left to deal with the physical and emotional trauma of the assault.
The community is left to wonder how such a violent act could occur, and what can be done to prevent such crimes in the future.
