Michael Bow Smith, 32, an enrolled member of the Mescalero Apache Nation from Mescalero, N.M., is headed to federal prison after being sentenced to 46 months for sexually abusing a minor. The grim outcome, handed down in Las Cruces federal court, marks the end of a years-long case rooted in betrayal and violation on tribal land.
Smith admitted to engaging in a sexual act with a 15-year-old victim on March 8, 2016, when he was 30 years old. The crime occurred within the boundaries of the Mescalero Apache Reservation in Otero County, placing the case under federal jurisdiction due to the nature of the offense and tribal sovereignty considerations.
Arrested on May 7, 2016, Smith was initially charged via criminal complaint. He later pled guilty on August 29, 2016, to a felony information detailing the abuse. No plea deal softened the reality of his admission: he knowingly preyed on a child under the protection of his own community.
Upon completion of his prison term, Smith will serve five years of supervised release and must register as a sex offender—a permanent mark that follows him into any community he reenters. Federal prosecutors made no concessions in seeking accountability, emphasizing the vulnerability of the victim and the breach of trust inherent in the crime.
The investigation was led by the Mescalero Agency of the Bureau of Indian Affairs’ Office of Justice Services, which works to enforce law and order in tribal jurisdictions where federal authority often intersects with local needs. The case was prosecuted by Assistant U.S. Attorney Aaron O. Jordan from the U.S. Attorney’s Las Cruces Branch Office.
The prosecution was conducted as part of Project Safe Childhood, a DOJ initiative launched in 2006 to combat child sexual exploitation.
